You are welcome to use the automatic renewal service (hereinafter referred to as "automatic renewal service" or "this service") provided by Shenzhen Mango Future Technology Co., Ltd. (hereinafter referred to as "Violy"). In order to protect the rights and interests of users (hereinafter referred to as "you"), please read all contents of this service agreement (hereinafter referred to as "this Agreement") carefully before using this service.
Unless you have read and agreed to all the contents of this Agreement, you have no right to use this service. If you purchase or use this service, it means that you have reached an agreement with Violy and voluntarily accept all the contents of this Agreement.
If you are under the age of 18, please use this service accompanied by or with the consent of the legal guardian; minors who exercise and perform the rights and obligations under this Agreement are deemed to have obtained the approval of the legal guardian. This Agreement is legally binding on you and your legal guardian.
1.1 This service is launched based on your demand for automatic renewal to avoid service interruption due to your failure to renew in time. Automatic renewal currently only has the subscription service period type of recurring monthly subscription, and the billing cycle fee is paid monthly.
1.2 If you activate this service through Apple ID ("Apple" in this Agreement refers to Apple Inc. and its affiliates), and you do not cancel the automatic renewal service 24 hours before the expiration of the next subscription service, then Apple will automatically deduct the service fee for the next subscription period from the balance of the Apple ID account (hereinafter collectively referred to as the "account") bound when you opened this automatic renewal service, 24 hours before the expiration of each subscription period, thereby extending the service validity period corresponding to the subscription period.
1.3 Please pay attention to the above-mentioned various accounts and the status of the deductible balance. If the renewal fails due to account problems or insufficient balance, you will be responsible for the risks or losses caused by it (such as the termination of corresponding rights, membership status, etc.).
2.1 In accordance with the relevant laws and regulations, in order to facilitate you to know the automatic renewal status, Violy will notify you by text message, in-site message, etc. 3 days before the deduction of the next subscription period, and the third-party payment channel may also send you a reminder notice before the deduction, so please pay attention.
2.2 Please pay special attention to the fact that based on the characteristics of the automatic renewal service, the automatic deduction will be completed in accordance with the method and time stipulated in Articles 1.1, 1.2, and 1.3 of this Agreement. If you do not explicitly cancel the automatic renewal service before the deduction, Violy will issue a deduction instruction for the next subscription period to the relevant subject according to your entrustment, and in principle, the fee deducted based on this instruction will not be refunded.
2.3 If there is an error in the process of deducting the fee, Violy and you should cooperate closely to find out the reason, and each bear the loss caused by its own fault; if the loss is caused by the unequal fault of both parties, both parties should bear the corresponding responsibility according to the degree of fault; if both parties are jointly responsible, the responsibility shall be equally shared by both parties.
2.4 Violy does not charge you any additional fees for the automatic renewal service, but Violy has the right to decide whether to charge extra for the automatic renewal service according to business development needs, and will announce it to you on the relevant page.
2.5 The service provided to you by Violy is limited to your use on the Violy App platform. Any use of paid services to avoid renewal by malicious cracking or other illegal means constitutes a violation of this Agreement. All legal consequences arising therefrom shall be borne by the perpetrator, and Violy will investigate the perpetrator's legal responsibility according to law.
3.1 Unless otherwise notified or announced by Violy, this service will be valid for a long time. This Agreement becomes effective after you choose to accept or use the service, and will be terminated when you terminate the service or cancel the paid service qualification.
3.2 In the event of any of the following situations, Violy has the right to immediately terminate the service to you, and it will not be liable to you or any third party for this:
3.3 Violy may choose to suspend or interrupt this service according to its own business decisions and other reasons. If such a situation occurs, Violy will notify you in the form of an announcement.
3.4 If you want to cancel the automatic renewal, you can cancel the automatic renewal 24 hours before the end of the next subscription period by the following methods:
3.5 After the successful cancellation of this service, it will not affect the paid service that you have successfully been deducted for and that has taken effect, and the paid service that has taken effect will not be automatically renewed after its expiration. Before you choose to terminate this service, the instruction that you have entrusted to Violy to automatically renew the payment is still valid, and Violy will not refund the fee deducted based on the instruction, and you will bear the relevant responsibilities.
4.1 Law and Dispute Resolution: This Agreement shall be governed by the laws of the People's Republic of China, and the application of all conflict of law provisions shall be excluded. In the event of a dispute, you and Violy agree to submit the dispute to the China International Economic and Trade Arbitration Commission for arbitration in accordance with its currently effective arbitration rules, and the trial will be conducted by three arbitrators. The arbitration award is final and binding on both parties. Arbitration costs shall be borne by the losing party.
4.2 If Violy does not exercise, does not exercise in time, or does not fully exercise the rights enjoyed under this Agreement or in accordance with the law, it shall not be deemed to have waived the right, nor will it affect Violy's future exercise of such rights.
